Terms of Use
These terms are an agreement between you and Roommatez (“Roommatez”, “we”, “us”) for using the Roommatez City app and website. Roommatez is currently operated by Adhiraj Chadha, an individual based in San Francisco, California. By creating an account you agree to these terms and to our Privacy Policy.
Please read the Dispute resolution section. It requires most disputes to be resolved by individual arbitration instead of in court, and waives class actions and jury trials. You can opt out within 30 days.
Who can use Roommatez
- You must be at least 18 years old.
- One account per person, using your own phone number.
- You’re responsible for what happens on your account.
Zero tolerance for objectionable content and abuse
Roommatez has no tolerance for objectionable content or abusive users. You agree not to post, send or share:
- harassment, threats, bullying or hate speech;
- sexual or explicit content, or unwanted sexual advances;
- discrimination based on race, ethnicity, religion, disability, sexual orientation, gender identity or any other protected characteristic, including in housing preferences where the law forbids it;
- scams, fake listings, requests for money or deposits before you’ve verified a place, or spam;
- someone else’s photos or personal information, or a fake identity;
- anything illegal.
Every profile and conversation has Report and Block. Blocking someone immediately stops them from contacting you and removes them from your feed. We review reports within 24 hours and remove offending content and accounts that break these rules.
Your content
You own what you post. You give us a worldwide, non-exclusive, royalty-free license to host, store, display and adapt it (for example, resizing photos) only to run and improve Roommatez. The license ends when you delete the content or your account, except for copies other users already have (such as messages you sent them) and backups that are overwritten on their normal schedule. You’re responsible for making sure your profile is accurate and that you have the right to share your photos.
Copyright complaints (DMCA)
If you believe something on Roommatez infringes your copyright, email roommatez.app@gmail.com with the subject “DMCA notice” and include: your contact details; the work you believe is infringed; where the material is in the app (the profile name and city, or a screenshot); a statement that you have a good-faith belief the use isn’t authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner, with your physical or electronic signature. We’ll remove infringing material promptly. If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address. We terminate the accounts of repeat infringers.
Meeting people and housing
Roommatez helps you find people; it isn’t a landlord, broker or background-check service. We don’t verify users’ identities, listings, or claims. Use your judgment: meet in public first, see a place in person, never send money to someone you haven’t met, and read any lease before signing. Any agreement you make with another user is between you and them.
Ending your account
You can delete your account at any time in Settings. We may suspend or remove accounts that break these terms or put other users at risk.
Disclaimers
Roommatez is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the app will be uninterrupted or error-free, and we aren’t responsible for the conduct of other users, on or off the app, or for any housing arrangement you make.
Limitation of liability
To the fullest extent the law allows, we won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Roommatez. Our total liability for any claim related to Roommatez is limited to the greater of $100 or the amount you paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not fully apply to you.
Indemnity
If someone brings a claim against us because of content you posted, how you used Roommatez, or your dealings with another user, you agree to cover our reasonable losses and costs, including legal fees, to the extent the law allows.
Governing law
These terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules. Except for arbitration and small-claims cases under the next section, any lawsuit must be brought in the state or federal courts located in San Francisco County, California, and you and we consent to their jurisdiction.
Dispute resolution and arbitration
- Talk to us first. Before filing a claim, email roommatez.app@gmail.com describing the issue. We’ll both try in good faith to resolve it within 60 days.
- Arbitration. If we can’t, you and we agree to resolve any dispute related to these terms or Roommatez by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. The arbitration can be done by video or phone, or in San Francisco or the county where you live. We’ll pay the filing and arbitrator fees beyond what you’d pay to file in court, unless the arbitrator finds your claim frivolous.
- Exceptions. Either of us may bring an individual claim in small-claims court, and either of us may go to court to stop infringement or misuse of intellectual property. Nothing here stops you from reporting issues to a government agency.
- No class actions. Claims may only be brought individually, not as a plaintiff or class member in any class, consolidated or representative proceeding, and the arbitrator can’t combine claims of more than one person. You and we waive any right to a jury trial.
- Public injunctive relief. This section doesn’t waive any right you have under California law to seek public injunctive relief. Any such request will be decided by a court after the individual arbitration ends.
- Opting out. You can opt out of this arbitration agreement within 30 days of creating your account by emailing roommatez.app@gmail.com with the subject “Arbitration opt-out” and your username. Opting out doesn’t affect the rest of these terms.
- Severability. If the class-action waiver is found unenforceable for a claim, that claim goes to court instead of arbitration. If any other part of these terms is found unenforceable, the rest still applies.
Changes
If we update these terms, we’ll change the date above and ask you to accept the new version in the app.
